IMPORTANT NOTICE: By submitting this application for a domain name, you confirm that you are
eligible to hold the domain name set out in this application, and that all information provided in
this application is true, complete and correct, and is not misleading in any way. If any of the
information is later found not to be true, or is incomplete, incorrect, or misleading in any way, or
if you have submitted this application in bad faith, the domain name licence can be cancelled and
you can permanently lose the use of the domain name.
1.0 USE OF THE WHOIS SERVICE
is subject to the following terms. If you do not agree to these terms you may not use this Whois service. You
may not use the Whois service:
- a) to allow, enable or otherwise support the transmission of unsolicited communications to any person,
by any means;
- b) using an automated electronic query process;
- c) to gain bulk access to Whois data (ie. other than by sending individual queries to the database
You acknowledge that the responsibility of keeping Whois data up to date is that of the domain registrant and
that Australia Domain Names bears no responsibility for the truth or accuracy of Whois data. The contents of the
Whois database may be subject to copyright protection. You may not copy, modify or distribute data obtained
from the Whois database that is subject to copyright. This Whois service may be withdrawn at any time, or the
conditions of its use changed, without notice to you.
2.0 REGISTRANT'S OBLIGATIONS -
throughout the Term of the Registrant Agreement with Design Your Website, the Registrant must:
- By submitting this application for a domain name, you confirm that you are eligible to hold the domain
name set out in this application, and that all information provided in this application is true, complete and
correct, and is not misleading in any way. If any of the information is later found not to be true, or is
incomplete, incorrect, or misleading in any way, or if you have submitted this application in bad faith, the
domain name licence can be cancelled and you can permanently lose the use of the domain name.
- Give notice to the Registry Operator, through the Registrar, of any change to any information in the
Registrant Data.
- Must not, directly or indirectly, through registration or use of its Domain Name or otherwise.
- register a Domain Name for the purpose of selling it;
- register a Domain Name for the purpose of diverting trade
from another business or web site;
- deliberately register misspellings of another entity's company or brand name in order to trade on
the reputation of another entity's goodwill
- register a Domain Name and then passively hold a Domain Name Licence
for the purpose of preventing another registrant from registering it.
The Registrant must not in any way:
- transfer or purport to transfer a proprietary right in any domain name registration;
- grant or purport to grant a registered domain name as security.
- encumber or purport to encumber a domain name registration.
Design Your Website does not represent or warrant the availability or registrability of any domain
name to the Customer. The Customer agrees that it will have no rights or cause of action against
Australia Domain Names if a domain name cannot be registered
- Design Your Website s will notify the Customer when the registration of a domain name is complete.
- Any act or commission by the Customer in respect of an actual and/or attempted registration of a
domain name prior to notification by Design Your Website s occurs at the sole risk of the Customer.
- Design Your Website will not at any time, assume any liability whatsoever in respect of the use by
the Customer of any domain name.
- Any disputes arising must be resolved between the parties involved.
- In the event of a dispute, Design Your Website s will not be obliged to become involved, or take part,
in a dispute but may, in its sole and absolute discretion:
(a) withhold or suspend a domain name; and or
(b) make written representations it deems fit to the Registry.
3.0 If Domain Expires or Non Payment after registration
- Letting your Domain Name Expire or from non payment will result in the Domain name going into
Redemption.The retrieval of Domain from this Redemption Period will have a fee of $200.00
- ' Design Your Website ' is not responsible for Domain Name Redemption. Please register your
Domain Name before expiration date.
4.0 NO refunds for
1. Domain Misspells when Design Your Website s receives your Domain Application.
- ' Design Your Website s' is not responsible for any refunds if the domain name being applied for has
been misspelled by the applicant. Once the Domain Name has been submitted to us, we will register it
for approval immediately.
2. For any .com.au/.net.au Domain Name without Submitting a ABN or ACN Number when Australia
Domain Names receives your Domain Application.
- ' Design Your Website s' is not responsible for any refunds if the .Com.au/.Net.au domain name has
being applied for without also submitting a valid ABN or ACN Number as specified on the application
Form. Once the Domain Name has been submitted to us, we will register it for approval immediately
which will be denied without this ABN or ACNNumber as required by the auDA. Please read carefully the
RULES for either a .Com.au or .Net.au Domain Name here
5.0 Indemnity
- The Customer agrees to indemnify and hold harmless Design Your Website and its employees,
contractors, agents and directors in full against any and all liabilities, claims, losses, damages, penalties,
actions, judgments, suits, costs or expenses of any kind arising under these terms and conditions,
including from the use by the Customer of any intellectual property rights of any third party and the
registration or use of domain names by the Customer.
- auDA currently has in place a dispute resolution policy called auDRP (the .au Dispute Resolution Policy)
which applies in the event of disputes between a registrar and a registrant, or between a registrant and
a third party, in relation to entitlements to domain names in .au. The auDRP binds the Registrar and the
Registrant as if it were incorporated in the Registrant Agreement.
- The Registrant acknowledges that auDA may develop and implement other dispute resolution policies
which are accessible by the Registrant as an alternative and further to any complaints handling
procedure prescribed by the Registrar. Such policies bind the Registrar and the Registrant as if they
were incorporated in the Registrant Agreement.
- The Registrant warrants that it meets, and continues to meet, the eligibility criteria prescribed in auDA's
Published Policies for registering a Domain Name. In the event that the Registrant ceases to meet such
eligibility criteria, the Domain Name Licence may be terminated by either the Registrar or auDA.
- The Registrant must not pursue any claim against auDA, and auDA is not liable for any direct, indirect,
special, punitive, exemplary or consequential damages, including but not limited to damages resulting
from loss of use, lost profits, lost business revenue or third party damages arising from any breach by
the Registrar of its obligations under the Registrant Agreement or the Registrar Agreement between
auDA and the Registrar.
- The Registrant agrees that auDA is not responsible for the use of any Domain Name in the Registry
database and that auDA is not responsible in any way for any conflict or dispute with or any actual or
threatened claim against a Registrar or Registrant, including one relating to a registered or unregistered
trademark, a corporate, business or other trade-name, rights relating to a name or other identifying
indicium or of an individual or other intellectual property rights of a third party or relating to the
defamation or unlawful discrimination with respect to any other person.
- Notwithstanding any other provision of this document and to the fullest extent permitted by law, auDA
will not be liable to the Registrant for consequential, indirect or special losses or damages of any kind
(including, without limitation, loss of profit, loss or corruption of data, business interruption or indirect
costs) suffered by the Registrant as a result of any act or omission whatsoever of auDA, its employees,
agents or sub-contractors. Nothing in this document is intended to exclude the operation of Trade
Practices Act 1974.
- auDA means .au Domain Administration Limited ACN 079 009 340, the industry self-regulatory body
responsible for administering domain names with the .au suffix.
6.0 Rules for Australia Domain Registration
If you want to register an Australian Domain Name, these rules will apply. During the registration process, you
will be required to meet the following requirements.
Com.Au/ Net.Au ( Please read carefully )
You must meet the requirements set-up by the auDA for purchasing this Domain Name with Com.Au/ Net.Au
Domain Extension.
- The Australian Domain extension Com.Au/ Net.Au will require 2 yrs registration.
- To own a Com.Au/ Net.Au you must be an Australian Registered Company, or Business with a
registered and Valid Australian Business Number (ABN, ACN )
- If a Valid ABN/ACN Number is not provided by an Applicant on the Online Domain Application Form, this
Domain Application is deemed invalid.
- There wll be no refunds if a Com.Au/ Net.Au Domain name is submitted without a Valid ABN or ACN
Number.
- Design Your Website is not responsible for the loss of this Domain Name by another party if this
application is deemed incorrect under these Terms.

The domain name you order should have a solid relationship to the business it represents.
For example:-
Ford Motor Company would be reasonably entitled to own:
ORG.AU / .ASN.AU
- To qualify for these domains your organisation must be a "non-commercial organisation".
- The domain name you register should have a solid relationship to the organisation to which it represents

Red Cross are reasonably entitled to own:-
- www.redcross.org.au
- www.rdhelp.org.a
ID.A
- Especially designed for individuals, who reside in Australia.
- You may register ANY personal name by which you are known.
For example:- Mary Brown would be reasonably entitled to own:-
www.brown-maryl.id.au www.littlemary.id.au www.maryb.id.au
